20 Jan CBD Companies Need Marketing Guidance from the FDA: Judge Rules
Green Roads, one of the CBD industry leaders and a proud brand available at Chillum CBD Dispensary, met a huge milestone for the industry earlier this month.
A lawsuit was put forth against the CBD company last year. The claim was that Green Roads was using medical claims to sell their products without the approval from the FDA.
US District Judge Ursula Ungaro ruled Jan 3rd that a CBD manufacturer shouldn’t have to face certain liability claims until the US Food and Drug Administration finishes work reviewing CBD policy. The FDA promised to have a policy out last year but has not delivered.
Instead they have been issuing warning letters to CBD companies for making medical claims.
Green Roads is one of several CBD manufacturers facing liability claims based on labeling and branding. A statement released by the FDA that CBD cannot be sold as a dietary supplement is the foundation for all those cases.
Ungaro also mentioned that the FDA should soon update their CBD guidelines. She also acknowledged that the state of Florida has begun regulating CBD products under their Department of Agriculture.
