Pot or Not? Hemp’s Confusing the Cops

Cannabidiol products, or CBD products, are causing quite a bit of confusion when it comes to the war on drugs.

CBD is now sold everywhere.  Showing up at gas stations, coffee bars, and juice shops.  Even spray tan places are starting to get involved (probably a horrible way to dose CBD but it does exist).

According to the 2018 Farm Bill, CBD is now legal in all 50 states.  However, the only stipulation is that it must be derived from the hemp plant.  The hemp plant is defined in the Farm Bill as a cannabis plant that contains less than .3% THC.

The most interesting products causing confusion is called Phytocannabinoid Rich Hemp Flower.  This flower looks, smells, and smokes just like pot.  The main difference is that it doesn’t get you high and it is 100% legal.   This is causing police a bit of a stir.

Probably the best example of this is happening down in Miami. A few months ago, Miami Dade State Attorney announced that they will no longer be seeking out misdemeanor cannabis arrests. Explaining that it was just to expensive for their department to pay for the test to tell the difference between cannabis and hemp.

That soon resulted in the City of Miami beach passing a resolution to ban the smoking of both hemp and cannabis in public.  Little did they know that was already illegal. 

Apparently, police in New York City boasted quite a bust, arresting a man and seizing more than 100 pounds of plants, that were apparently hemp plants (see their tweet below). Both the Vermont Farm that grew the plants and the Brooklyn CBD shop insist they are legal hemp plants.

CBD Regulations are Coming Soon

The USDA recently came out with some regulations regarding the cultivation and sale of hemp products. Some of which might be challenging to the CBD industry.

Soon regulations will go into effect on the sale of CBD in Florida.  Requiring specific packaging with QR codes that, when scanned, shows the test results proving the low levels of THC. We advise anyone purchasing Phytocannabinoid Rich Hemp Flower to make sure the packaging has a functioning QR code and is labeled correctly.  Always keep the flower in its original packaging.
